The licensing contract has established itself today as an essential contract since several millions are concluded each year and it affects all areas and all socio-professional categories, particularly consumers. However, these contracts can raise several issues when they are concluded on foreign platforms: which jurisdiction has territorial jurisdiction? What is the applicable law? Where is the place of the co-contractor in these adhesion contracts? Is there consumer protection in these contracts? The question arises more when a physical medium contains a license agreement. It even becomes more complex when two licensing contracts are concluded, notably through an operator who acts as a data library.
