Essai critique sur l'économie de la justice : l'état social comme objet, l'unanimité comme outil

L'economie de la justice concerne la tentative d'economistes contemporains d'aborder un theme d'ordre normatif -la justice socialeavec leur methode d'analyse positive -l'individualisme methodologique-. Un detour de la reflexion par la philosophie morale et sociale contemporaine permet de relativiser la progression des debats internes a l'analyse economique : - selon une approche strictement endogene, l'economie de la justice cherche a conjuguer les idees de justice -d'inspiration utilitariste (bentham)- et d'unanimite -fondee sur l'optimalite de pareto-; soit le principe utilitariste du "plus grand bonheur du plus grand nombre" devient le critere plus precis de richesse maximale (posner), soit l'optimalite "paretienne" est redefinie dans un contexte elargi d'in- terdependance des preferences (archibald et donaldson, hochman et rodgers, etc. . . ). En fait ces efforts tenaces sont desesperes car la theorie economique de l'envie (kolm, varian, etc. . . ) est conduite a constater la divergence redoutee entre justice et unanimite. - par ailleurs une lecture exogene revele surtout l'obstination de l'economie de l'ethique a cerner la justice d'un etat social independamment de toute reflexion approfondie sur la procedure dont l'etat social est issu ; a la fatalite pour hayek de l'injustice de toute procedure forcement impure s'opposent pour nozick la ne- cessite d'une procedure pure de justice et la volonte d'harsanyi et de rawls de promouvoir une justice procedurale parfaite.
Economics of justice concerns attempts of present-day economists who approach a normative question -social justice- with their positive analysis -methodological indidualism-. A roundabout way through social and moral contemporary philosophy makes the progress of debates inside economic analysis relative : -from an inner point of view, economics of justice tries to combine the notion of justice -which results from utilitarianism (bentham)- and the notion of unanimity -based on pareto optima- lity-; either the utilitarian principle of "the greatest happiness for the greatest number" becomes the more precise criterion of wealth maximization (posner) or the "paretian" optimality is de- fined again in a broader context where the preferences are inter- dependent (archibald and donaldson, hochman and rodgers,. . . ). As a matter of faot these tenacious efforts are hopeless for the economic theory of envy (kolm, varian,. . . ) is induced to note the feared divergence between justice and unanimity. - moreover an outer reading mainly shows how much economics of ethics is bent on defining the justice of a social state indepen- dently of any careful reflection about the procedure from which the social state stems ; the fatal injustice of any inevitably impure procedure (hayek) is opposed to the need of pure procedural justice (nozick) and to the wills of harsanyi and rawls to promote perfect procedural justice.
