Forme d'organisation du monde la plus achevée à ce jour, les Nations Unies reposent sur un véritable fondement constitutionnel. La Charte de San Francisco donne naissance à une organisation dotée de la personnalité juridique et d'organes aptes à concrétiser ses objectifs. Cette organisation doit cependant encadrer une vie internationale mouvante. Elle prévoit donc en ses articles 108 et 109 sa propre procédure de révision. Or, le rôle que ces articles attribuent aux Etats membres, confère à cette procédure un caractère politique, facteur de rigidité. Trop statique, la Charte risque alors une inadaptation aux situations qu'elle est censée régir. La pratique des Nations Unies a donc pris certaines libertés par rapport aux dispositions de son texte fondateur, dans le but de remplir ses obligations de maintien de la paix et de la sécurité internationales. Dénoncées comme de véritables révisions de facto, ces adaptations révélèrent une incompatibilité entre un strict respect de la Charte, et l'efficacité de l'Organisation. La conciliation de ces deux objectifs semble devoir être résolue au profit de l'efficacité au vu des évolutions récentes.

This organization must meanwhile frame an international moving life. It makes provision for then in his articles 108 and 109 its review procedure. But, the role that those articles assign to members States, confer to this procedure a political character, customs agent of rigidity. Too static, the Charter would risk a maladjustment to situations that it is deemed to govern. Then, the UN practise tooks some relative rights to provisions of its Charter in order to fill his bonds of deportment of peace and international security keeping. Declared as of real review in facto, those adaptations revealed an incompatibility between a strict respect of the Charter, and the efficacity of the Organization. The conciliation of those two objectives seems to must be cancelled to the profit of the efficacity to the sight recent evolutions.
